Terms of service

These Terms of Service ("Terms") govern your access to and use of the PureChems website at purechems.eu, including shop.purechems.eu (together, the "Site"), and every order you place through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site and do not place an order.

Please read these Terms together with our Refund policy, Shipping policy, Privacy policy, Cookie policy and Research use disclaimer. Each of them forms part of your agreement with us.

1. Definitions

  • "PureChems", "we", "us" and "our" mean the operator of the Site.
  • "Customer", "you" and "your" mean any person who visits the Site or places an order.
  • "Products" means the research peptides, nootropics, research chemicals and related items offered for sale on the Site.
  • "Order" means a request to buy Products that you submit through the checkout.
  • "Business day" means Monday to Friday, excluding public holidays.

2. Eligibility

The Site and the Products are intended only for adults. By using the Site or placing an order, you confirm that:

  • you are at least 18 years of age, or the age of majority in your country if that is higher;
  • you have the legal capacity to enter into a binding contract;
  • you are a researcher, a qualified professional or an institution, and you are buying the Products for lawful research purposes only;
  • all information you give us, including your name, email address, phone number and delivery address, is accurate, current and complete.

When you first open the Site, you are asked to confirm that you are 18 or older. You may not use the Site if you cannot truthfully give that confirmation. We may refuse service, cancel an order or restrict access to the Site at our discretion, in particular where we have reason to believe that any of the statements above is not true.

3. Research use only

All Products are sold strictly for laboratory and in-vitro research use. They are not intended for human or animal consumption, and they are not sold for any diagnostic, therapeutic, medical, veterinary, cosmetic, food, household or drug use. The Products are not approved by any medicines or food authority for any such use. Nothing on the Site is medical advice.

At checkout you are asked to tick a box confirming that you are buying the Products for research use only. An order cannot be placed without this confirmation. By ticking it and by placing an order, you agree that:

  • you will handle, store and use the Products in line with good laboratory practice and all laws and regulations that apply to you;
  • you take full responsibility for the safe and lawful handling, storage, use and disposal of the Products;
  • you will not resell, supply or give the Products to any person for consumption, or for any purpose that is prohibited by law;
  • you accept all risk and liability arising from your possession or use of the Products.

We will cancel any order, and may refuse future orders, where we have reason to believe that the Products are intended for human or animal use or for any other purpose these Terms do not allow. The full statement is set out in our Research use disclaimer.

4. Products and product information

We take care to describe each Product accurately, including its specification and, where available, its Certificate of Analysis (COA). Product photographs are for illustration, and the packaging or label of the item you receive may differ in appearance from the image shown. We do not warrant that descriptions, images or other content on the Site are free of errors. If we find an error in the description of a Product you have ordered, we will tell you and give you the choice of continuing with the order or cancelling it.

Product information on the Site, including any reference to published research, is provided for scientific and reference purposes. It does not describe, recommend or suggest any use of a Product in humans or animals.

5. Prices and availability

All prices on the Site are shown in euros (EUR). The total you pay, including the cost of shipping to your chosen country and any discount applied, is shown at checkout before you confirm payment. Prices may change at any time without notice, but a change will not affect an order that has already been paid.

We may correct pricing errors, limit the quantities that can be ordered, and withdraw any Product from sale at any time. All orders are subject to availability. If a Product you have paid for is not available, we will tell you and refund the amount paid for it.

Discount codes can be entered at checkout or applied through a discount link. A discount code is valid only on the terms under which it was issued, and it is checked when the order is placed. A code that is invalid, expired or used outside its terms will not be applied.

6. Orders and acceptance

When you place an order, you make an offer to buy the Products in your cart at the price shown at checkout. After you place the order, we send you an email confirming that we have received it. That email is not an acceptance of your offer. A binding contract between you and us is formed only when we dispatch the Products to you.

We may refuse or cancel any order before dispatch, for any reason, including suspected fraud, a pricing or description error, lack of stock, an incomplete or doubtful delivery address, or a reasonable suspicion that the Products are intended for a use these Terms do not allow. If we cancel an order that you have already paid for, we will refund the full amount to you.

7. Payment

Payment is made in full when you place the order, using one of the payment methods offered at checkout. You confirm that you are authorised to use the payment method you choose. Orders are not dispatched until payment has cleared.

7.1 Card payments

Card payments are processed by third-party payment processors on their own hosted secure payment page. Your card details are entered directly on that page and are never received or stored by us. We receive only the information needed to confirm that the payment for your order has succeeded.

7.2 Cryptocurrency payments

We accept payment in USDT, USDC, ETH, BNB, BTC and SOL, on the networks offered at checkout. When you choose to pay in cryptocurrency, the order total in euros is converted into an amount of the selected coin, and that quote is locked for 15 minutes. To complete your order, the exact amount shown must be sent to the address shown, on the network shown, within that time. If the quote expires before payment arrives, you will need to request a new quote, which may be for a different amount.

You are responsible for any network or transaction fees charged by your wallet or exchange, and for sending the correct amount, in the correct coin, on the correct network. Blockchain transactions cannot be reversed. Funds sent to a wrong address or on a wrong network may be lost and cannot be recovered by us.

8. Delivery

Processing times, carriers, delivery estimates and costs are set out in our Shipping policy. Delivery times are estimates and are not guaranteed.

Title to the Products and the risk of loss or damage pass to you when the Products are handed to the carrier. Claims for damaged, wrong or missing items are handled as described in our Refund policy.

You are responsible for giving a correct and complete delivery address. We are not responsible for delays, losses or failed deliveries caused by an incorrect or incomplete address, or by the parcel not being collected or accepted.

For deliveries outside the European Union, any customs duties, taxes or import fees are payable by you. You are solely responsible for making sure that the Products may lawfully be imported into, and held in, your country.

9. Refunds and cancellations

Because our Products are sensitive research materials with strict storage and handling requirements, our return rules are strict. The full rules, including how to make a claim, are set out in our Refund policy. In summary:

  • Opened, unsealed, used, reconstituted or improperly stored Products cannot be returned, exchanged or refunded.
  • We provide a replacement or a refund if a Product arrived damaged, if you received the wrong item or quantity, or if a Product is defective or does not match the specification on its Certificate of Analysis.
  • Any such claim must be reported to support@purechems.eu within 48 hours of delivery, with your order number, a description of the problem and clear photographs of the Product, the packaging and any visible damage.
  • Sale, clearance and specially discounted items, and orders sent to an incorrect or incomplete address that you provided, are not eligible for a refund.
  • Sealed, unopened Products in their original condition may be returned within 14 days of delivery. Return shipping costs are paid by you, and you are responsible for the Product reaching us undamaged and properly stored.
  • Approved refunds are paid to the original payment method. Please allow 5 to 10 business days for a refund to appear, depending on your bank or payment provider.

Cancelling an order

You can cancel an order only before it has been dispatched. To cancel, email support@purechems.eu as soon as possible with your order number. If the order has not yet been handed to the carrier, we will cancel it and refund the full amount to the original payment method. Once an order has been handed to the carrier, it can no longer be cancelled, and the Refund policy applies.

10. Your responsibilities and compliance

You are solely responsible for making sure that the purchase, import, possession and use of the Products are lawful where you are. Rules differ from country to country, and you must check the rules that apply to you before you order. We are not responsible for any Products that are seized, delayed or refused by customs or by any other authority, and no refund is guaranteed in such cases.

11. Use of the Site

You may use the Site only for lawful purposes and in line with these Terms. You must not:

  • use the Site in a way that breaks any law or regulation;
  • try to gain unauthorised access to the Site, its servers or any connected system, or interfere with how the Site works;
  • copy, scrape or collect content or data from the Site by automated means without our written permission;
  • place orders using false details, or using a payment method you are not authorised to use;
  • misuse discount codes, including by creating or sharing codes you were not given.

We may suspend or block access to the Site for anyone who breaks these rules.

12. Intellectual property

All content on the Site, including text, product descriptions, graphics, logos, photographs, page layouts and the PureChems name, belongs to PureChems or its licensors and is protected by intellectual property laws. You may view the Site and print or save pages for your own reference. You may not copy, reproduce, publish, distribute or otherwise use any content from the Site for any other purpose without our prior written permission. Other names and marks shown on the Site belong to their respective owners.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Site and the Products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement, except for warranties that cannot be excluded under applicable consumer law. We do not warrant that the Site will be uninterrupted, secure or free of errors, or that any Product is suitable for any particular research application.

14. Limitation of liability

To the fullest extent permitted by law, PureChems is not liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, data or opportunity, arising from the use of the Site or the Products. PureChems is not liable for any loss or damage arising from the use or misuse of the Products, including any use that breaches section 3 of these Terms.

Our total liability for any claim relating to an order is limited to the amount you paid for the Products that gave rise to the claim. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

15. Indemnity

You agree to indemnify and hold harmless PureChems, its owners, staff and partners against any claims, damages, losses, liabilities and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Products, or your breach of any law or of the rights of any third party.

16. Events outside our control

We are not responsible for any delay or failure to perform our obligations that is caused by events outside our reasonable control, including carrier delays, customs checks, strikes, severe weather, natural disasters, epidemics, power or network failures, or actions of public authorities. If such an event affects your order, we will tell you and keep the delay as short as we reasonably can.

We handle your personal information as described in our Privacy policy and our Cookie policy.

18. Governing terms

18.1 Governing law and disputes

These Terms and any contract between you and us are governed by the laws of the Slovak Republic and by the applicable law of the European Union, without regard to conflict-of-law rules. Any dispute is subject to the jurisdiction of the competent courts of the Slovak Republic. This does not affect any mandatory consumer protection rights you have under the law of your country of residence. Before taking any formal step, please contact us at support@purechems.eu so that we can try to resolve the matter with you directly.

18.2 Order of precedence

If these Terms conflict with any other policy on the Site, these Terms prevail, except that the Privacy policy prevails on matters relating to personal information.

18.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the greatest extent permitted, and the remaining provisions will continue in full force.

18.4 No waiver

If we do not enforce any of our rights under these Terms straight away, that does not mean we have given up that right, and we may still enforce it later.

18.5 Transfer

We may transfer our rights and obligations under these Terms to another party. You may not transfer your rights or obligations under these Terms without our written consent.

18.6 Changes to these Terms

We may update these Terms at any time. The updated version takes effect when it is published on this page, and the date at the top of the page shows when it was last changed. The version in force when you place an order applies to that order. By continuing to use the Site after a change, you accept the updated Terms.
